These Terms of Use (the "Terms") govern your access to and use of the WeSnus application. By creating an account, you accept these Terms unconditionally. If you refuse them, please uninstall the application immediately.
1. Health, Safety and Age (Critical)
Access to WeSnus is strictly prohibited for minors. By using this service, you certify on your honour that you are 18 years of age or older. Any false declaration will result in immediate account deletion.
⚠️ Nicotine Warning
Products referenced in this application contain nicotine, a highly addictive substance. WeSnus does not manufacture, sell or distribute any products.
- Non-incitement: This application is a "Quantified Self" (personal tracking) and community information tool. It must not under any circumstances be interpreted as promotion of nicotine consumption.
- No medical advice: Content (including health or consumption statistics) is provided for informational purposes only. It does not replace the advice of a healthcare professional.
2. Community Rules (EULA) and Moderation
To maintain a safe environment, you agree to comply with the following rules. Zero Tolerance: Any violation will result in a ban.
- No Trading: It is strictly prohibited to use WeSnus to sell, resell, exchange or distribute products (snus, nicotine pouches) between users. We are not a marketplace.
- Prohibited Content: No hate speech, harassment, nudity, violence, or illegal content.
- Respect for Others: Reviews and comments must remain courteous. Trolling and spam are prohibited.
Reporting and Blocking: Users can report any inappropriate content via the "Report" button and block any abusive user via the "Block" button (available on posts and profiles). Our moderation team commits to processing reports and acting within a maximum of 24 hours to remove unlawful content and/or ban the author.
3. Intellectual Property
- Our Content: The code, design, logo and database of WeSnus are our exclusive property.
- Your Content: You remain the owner of your photos and reviews. However, by publishing them, you grant WeSnus a worldwide, royalty-free licence to host, display and use them in the context of the normal operation of the service, for as long as your account is active and the content has not been deleted by you.
- Warranty: You warrant that you own the rights to the photos you post. You must not post images taken from the Internet without authorisation.
4. Premium Subscriptions and Right of Withdrawal
Transactions are managed by third-party platforms (Apple App Store / Google Play Store).
- Renewal: Automatic unless cancelled 24 hours before the end of the period (Store rules).
- Cancellation: Only you can cancel via your phone's settings. We do not have access to your banking details to stop a payment manually.
- Right of withdrawal: By subscribing to a Premium plan and immediately accessing the paid features (digital content), you expressly waive your statutory 14-day right of withdrawal in accordance with applicable law.
5. Limitation of Liability
- "AS IS" Service: WeSnus does not guarantee that the application will be bug-free or available 100% of the time.
- Product Data: The database is collaborative. We do not guarantee the accuracy of the nicotine levels displayed. Always check the physical product packaging.
- Indemnification: You agree to indemnify WeSnus against any liability (including legal fees) in the event of a third-party claim arising from your violation of these Terms.
6. Amendments and Termination
We may modify these terms at any time. Continued use of the application constitutes acceptance. We reserve the right to suspend or delete your account, without notice or refund, in the event of a violation of these rules.
7. Applicable Law and Mediation
These Terms are governed by French law. In accordance with applicable consumer law, we offer a consumer mediation process. The designated mediation body is CM2C. If a dispute cannot be resolved with our support team, you may submit your complaint via their website: www.cm2c.net or by post to CM2C, 14 rue Saint Jean, 75017 Paris. In the absence of an amicable resolution, the French courts shall have sole jurisdiction.
